Michigan Gets Bitchy Over Label

They say you can’t judge a book by its cover, but can you judge a beer by its label?  Beer becomes a first amendment issue.  @JayeMarie, beer lover & future lawyer helps breakdown the legal side of this beer issue.

The Breakdown: Flying Dog filed suit in federal court this week against the Michigan Liquor Control Commission (MLCC) with the request that the federal judge overturn the state-wide ban on one of its top selling beers, Raging Bitch, and award Flying Dog damages for the loss of sales due to the ban.

All out of state beer manufacturers must apply to the MLCC for a license to sell their product within the state of Michigan.  Failure to do so may result in criminal charges.

Flying Dog first applied for a license to sell Raging Bitch in 2009 but was turned down.  The brewery appealed only to be turned down again because according to the MLLC, the brew’s name, label, and statement on the back “contains such language deemed detrimental to the health, safety or welfare of the general public.”

Flying Dog Brewing has released the first beer in their new “Alpha Collection” starting tomorrow. The collection celebrates hops with 12 packs that have a the limited release single hopped IPA’s, in addition to other beers from FD’s collection. The first single hop offering celebrates simcoe hops.

About The Alpha Collection:

The Alpha Collection has officially been unleashed on Maryland (with more markets to come). This limited-release package is “an homage to the hop” 12-pack that features our Single Hop Imperial IPA with Simcoe, Raging Bitch Belgian-Style IPA, Snake Dog IPA, and Doggie Style Classic Pale Ale. Caged in 12 oz. bottles for the first time, our Single Hop Imperial IPA with Simcoe can only be found in this Collection. (Unless it’s on draft at your local watering hole. If that’s the case bow down to the hop Gods and thank your lucky stars.)

Flying Dog’s Beer For Your Backyard

That’s why our Brewmaster Matt Brophy teamed up with Chef Bryan Voltaggio to create Backyard Ale – a smoked amber ale that’s the perfect complement to all things grilled, charred, broiled, roasted, and (obviously) smoked.

We brewed our first batch with Bryan today, so as the days get warmer, this beer will be fermenting. More details on its release coming soon!

Michigan Gets Bitchy Over Label

Flying Dog’s newly filed complaint alleges their “core First Amendment” rights were violated when the MLCC banned the sale of Raging Bitch because the MLCC has “taken it upon themselves to control not merely alcoholic beverages, but speech as well.”

On his company’s blog, Jim Caruso, CEO or Flying Dog said he believes it is about a lot more than a mere beer label, “We believe not only in freedom of speech and artistic expression for both businesses and individuals, but also in the individual’s fundamental right to choose or reject books, art, literature, artisanal craft beer, and other forms of artistic expression based on their personal preferences.”

Why it’s concerning: With the rapid growth in the craft brewing, many brewers have already, or will face this problem when they look to expand their business. With greater nationwide distribution, each individual state’s alcohol licensing board determines what is acceptable.  This is exactly why the Center for the Defense of Free Enterprise has joined Flying Dog in their case. In a statement on Flying Dog’s blog, lan Gottlieb, president of the center said, “The issues raised have a profound impact on the right to freely engage in the marketplace.”

NEW RELEASE: Flying Dog Raging Bitch

I know I have called people this.  However, I have never called my beer this. Until now.

Flying Dog Brewing ( Frederick, MD) finally released it’s 20th Anniversary brew- “Raging Bitch.”  Keep in mind this is reference to dogs – and all the FLYING DOG beers have dog references.  Raging Bitch is a Belgian IPA, the first by the brewer.  Flying Dog took  one of their American IPA recipes, and used a Belgian yeast strain.

Ingredients:

Hops – Warrior, Columbus, Amarillo. Dry Hop – Amarillo

Malts – 60L Crystal is the only specified

Yeast – Flying Dog “El Diablo” yeast (Belgian strain)

Label:

Two inflammatory words… one wild drink.  Nectar imprisoned in a bottle. Let it out.  It is cruel to keep a wild animal locked up.  Uncap it.  Release it…. stand back!! Wallow in its golden glow in a glass beneath a white foaming  foaming head.  Remember, enjoying a RAGING BITCH, unleashed, untamed, un-bridled – and in heat – is pure GONZO!  It has taken 20 years to get from there to here.  Enjoy! – Ralph Steadman
